Terms & Conditions

Applies to all services provided by Tradie Web Services.

1 Introduction

These Terms & Conditions govern the provision of services by Tradie Web Services ("we", "our", or "us").

By engaging Tradie Web Services for website design, development, hosting, maintenance, or marketing services, the client ("you" or "the client") agrees to these Terms.

2 Services

Tradie Web Services provides services including but not limited to:

  • Website design and development
  • Website hosting and infrastructure management
  • Website maintenance and updates
  • Domain connection and configuration
  • Search engine optimisation (SEO) services
  • Digital marketing and advertising setup

Services are delivered according to the package, proposal, or invoice agreed with the client. Any work requested outside the agreed scope may incur additional charges.

3 Project Scope

Website build packages include the number of pages and functionality outlined in the agreed service package. Work outside the agreed scope may incur additional charges. Examples include:

  • Additional pages
  • Advanced functionality
  • Custom integrations
  • Major design revisions
  • Additional content creation

4 Client Responsibilities

The client agrees to provide all information necessary to complete the project, including:

  • Business information
  • Service descriptions
  • Logos
  • Images and media
  • Contact details

The client is responsible for ensuring all content provided is accurate and does not infringe copyright, trademark, or other legal rights. Tradie Web Services is not liable for legal issues arising from client-supplied content.

5 Project Timelines and Client Delays

Project timelines depend on the timely provision of content and feedback from the client.

If required information or feedback is not provided within 30 days, the project may be paused. Projects delayed longer than 60 days may require a restart fee before work resumes.

6 Revisions

Reasonable revisions are included during the website design and development process.

Major design changes, structural changes, or additional functionality requested after approval may incur additional charges. Once a website is approved and published, further changes are considered website updates and may be billed separately unless covered by a maintenance plan.

7 Payments

Invoices must be paid by the due date listed on the invoice. Tradie Web Services reserves the right to pause work or suspend services if payment is not received. Late payments may result in:

  • Suspension of hosting
  • Suspension of maintenance services
  • Temporary removal of the website from public access until payment is received

8 Website Hosting

Websites hosted by Tradie Web Services are deployed using proprietary hosting infrastructure and deployment systems. While the client retains ownership of their website content and branding, the hosting infrastructure, server configuration, deployment systems, and management processes remain the property of Tradie Web Services.

Website hosting services are provided on a minimum 12-month service term. Hosting fees are billed monthly; however, the client agrees to a 12-month hosting commitment from the date the website is launched.

If hosting is cancelled before the end of the 12-month term, the remaining balance of the hosting term may become payable. After the initial 12-month term, hosting continues on a month-to-month basis unless cancelled with 30 days written notice.

9 Cancellation of Services

Monthly services such as hosting, maintenance, and marketing may be cancelled with 30 days written notice after the initial service term.

If a client chooses to transfer their website to another provider, Tradie Web Services may provide a website export where technically feasible. Migration or transfer assistance may incur additional fees. Once a website has been transferred away from Tradie Web Services infrastructure, ongoing support is no longer provided unless agreed separately.

10 Domains

Domains purchased on behalf of clients remain the property of the client unless otherwise agreed. Tradie Web Services may assist with domain setup or management but is not responsible for domain renewal failures, registrar outages, or issues caused by third-party domain providers.

11 Third-Party Services

Websites may rely on third-party platforms including hosting providers, domain registrars, email providers, analytics platforms, and advertising platforms. Tradie Web Services is not responsible for outages, security incidents, or service disruptions caused by third-party providers.

12 SEO and Marketing Disclaimer

Search engine rankings, advertising performance, and website traffic depend on external factors including competition, search engine algorithms, market demand, and advertising budgets. Tradie Web Services does not guarantee specific rankings, traffic levels, or marketing results.

13 Limitation of Liability

Tradie Web Services is not liable for:

  • Loss of revenue
  • Loss of profits
  • Loss of business opportunities
  • Loss of data
  • Website downtime
  • Failures caused by third-party services

Total liability relating to any service will not exceed the amount paid by the client for that service.

14 Intellectual Property

Upon full payment of a website build, the client owns the website content, text, and media supplied for the project. Tradie Web Services retains ownership of its internal systems, development frameworks, deployment infrastructure, and technical processes used to deliver services.

15 Suspension of Services

Tradie Web Services reserves the right to suspend services if payments are overdue or if the client breaches these Terms. Websites hosted by Tradie Web Services may be temporarily disabled until outstanding payments are resolved.

16 Changes to Terms

Tradie Web Services may update these Terms & Conditions from time to time. Updated terms apply to all new and ongoing services.

17 Governing Law

These Terms & Conditions are governed by the laws of Australia.
